Tennessee’s attempt to execute death row inmate Christa Pike failed dramatically on Wednesday evening, after two doses of lethal injection drugs did not stop her heart. The 50-year-old — the only woman on the state’s death row and the first woman Tennessee was set to execute in more than 200 years — was taken to a nearby hospital, where she remains alive, her attorneys said.

The Christa Pike execution attempt

The Christa Pike execution attempt began only after a full day of legal battles. Around 9 a.m. on Wednesday — one hour before the execution was originally scheduled — the U.S. Court of Appeals for the Sixth Circuit granted Pike a temporary stay. Tennessee’s Attorney General’s office immediately appealed, and the U.S. Supreme Court vacated the stay around 5:50 p.m. in a 6-3 decision, clearing the way for the procedure.

According to an emergency motion filed by Pike’s attorneys, prison officials began the execution at about 8 p.m. CT and administered both syringes of the lethal drug pentobarbital. But Pike “has not lost consciousness and still has a heartbeat and is audibly snoring,” the motion stated.

The motion also noted that the curtains to the witness room went down twice during the process, and it demanded that the Tennessee Department of Correction begin lifesaving measures immediately.

What witnesses described

Media witnesses who were allowed into the viewing room described a chaotic and distressing procedure. After the curtains opened that evening, Pike spoke what she thought would be her last words: “I’m going to leave this world the way I spent most of my life, and that is with love.”

As the drugs were administered, Pike repeatedly complained of pain. “The vein in my arm feels like it’s about to bust,” witnesses recalled her saying. One doctor, Mark Walton Fowler, could not establish a central line, and the media witnesses said they heard heavy snoring as Pike remained conscious.

Late Wednesday night, Pike’s legal team released a statement saying she was being treated at a nearby hospital — and that they had not been informed of her condition: “Tonight the State of Tennessee once again failed to carry out a lawful execution. We take no pleasure in being right, but the concerns raised by Ms. Pike proved to be true: difficult vein access, blown veins, degraded pentobarbital, no emergency medical care available when things inevitably go wrong, all under a protocol that remains veiled in secrecy.”

The Tennessee Department of Correction defended its actions, saying in a statement that it “followed every step of the State’s lawful, established execution protocol approved by the Attorney General’s Office,” adding that “the protocol does not allow for additional procedures beyond what was carried out this evening” and that “Christa Pike has been transported to an off-site medical facility.”

Tennessee’s troubled execution record

The failed attempt is the latest in a string of problems with Tennessee’s death penalty procedure. In May, the state’s attempted execution of Tony Carruthers was abandoned after medical staff failed to establish IV access — a process that took more than an hour. Earlier botched executions had prompted Tennessee Governor Bill Lee to pause executions entirely.

Pike would have been the first woman executed in Tennessee in more than two centuries. She has been on death row since her conviction for the 1995 killing of Colleen Slemmer, a case that drew national attention.

What happens next

Tennessee Governor Bill Lee — who had denied Pike’s clemency petition on Monday — suspended all executions in the state for the rest of the year and ordered a “comprehensive, third-party review to determine exactly what occurred,” in a statement reported by the Nashville Tennessean. “Carrying out a lawfully imposed sentence is among the State’s most serious responsibilities, and the people of Tennessee expect it to be done in a manner that is not only legal and constitutional, but is effective,” Lee said.

Robin M. Maher, executive director of the Death Penalty Information Center, called what Pike experienced “singular and unparalleled.” Pike’s defense team has also filed an emergency motion to halt any further action, arguing that the procedure violated her right to be free of cruel and unusual punishment.
